Just contact them via the Apple Store phone and claim the programs, as iPods shipped after MacWorld already come with the applications as standard.

I will explain exactly the problem below. You could say that the post is and is not right, that is, what I have commented is 100% real and is contemplated within the Apple Sales Policy.
But in the case of the iPod touch, it’s not obvious. Why? Because the “Apple Sales Policy” does not include new software as a new product , so the iPod touch+5 program is really just an update and not a new iPod.
Obviously this only happens with this specific case, here the error of the post, since any other product modified in a Keynote, that is not software, and bought in the 15 days previous to the keynote will be returned or modified by the new ones.
