Apple has issued a cease and desist letter to the author and publisher of a new book entitled App Store Confidential on the grounds that the former Apple manager has incurred secrecy. Apple states that Tom Sadowski is in breach of his employment contract by revealing company secrets of considerable economic value . The book, edited in German, was published yesterday as an ebook and also in physical format.
In the letter, Apple’s lawyers ask Sadowski and Murmann Verlag, its publisher, to stop the distribution of the book, remove the copies already in circulation and destroy all the manuscripts . Murmann and Sadowski have refused to comply with the request.
Tom Sadowski, who ran the German App Store until November 2019, denies that he reveals any company secrets in his book. However, Apple insists that he is in breach of his contract and that confidentiality applies to all employees equally. It says so in a statement:
The truth is that all employees sign confidentiality agreements according to their different jobs. Many have confidentiality clauses in the same contract, others, especially higher level executives, sign confidentiality contracts in order to see their contracts . Under these contracts, Apple can take Sadowski to court as long as it can prove that there are damages to the company for its breach.
At AppleThere will be a second audience in the battle between Apple and VirnetX
So far the movement on the part of Apple has given the book quite a bit of publicity in something known as the Streisand effect. Undoubtedly, Apple will not stand idly by if it considers that the company’s interests have been illegally harmed .
